Confluence Labour Relations & Strategy

Properly Considered

Deciding the right level of discipline, before you decide it.

Terms of use

You use this instrument at your own risk.

It is free. No fee is charged and none will be. Nothing you enter is transmitted, uploaded or stored. It runs entirely in your browser and is gone when you close the tab.

It does not decide anything. It produces no finding, carries no authority of its own, and is not evidence of anything. It is a structured way of working through the factors an arbitrator would weigh, so that you can record that you considered them before you decided. The decision is yours and stays yours.

It is not legal advice. Confluence Labour Relations & Strategy Inc. is not a law firm and is not acting as your counsel. Using this instrument creates no solicitor-client relationship, attracts no privilege, and is a complement to legal advice rather than a substitute for it. Where the assessment indicates that termination may be appropriate, obtain legal advice before acting.

It comes with no warranty. It is provided as is. No representation is made that it is accurate, complete, current, or fit for any particular matter. Labour and employment law differs between jurisdictions and changes over time, and the instrument cannot know the facts of your matter, your collective agreement, your contracts of employment, or your statutory obligations.

You use it at your own risk, and you are responsible for what you do with it. To the fullest extent the law allows, Confluence Labour Relations & Strategy Inc. and Sam Kemble accept no liability for any loss or damage of any kind arising from your use of this instrument or from any decision you take after using it, including any grievance, arbitration, complaint, claim or proceeding that follows.

Employee information. Anything you type here concerns a real person who did not agree to be assessed by software. It stays in your browser, and how you handle the printed report afterwards is your responsibility under the privacy and employment law that applies to you.

Governing law. These terms are governed by the laws of the Province of Alberta.

Before you start

Two questions that decide whether this instrument applies at all.

It weighs how much discipline is warranted. It does not decide whether the conduct happened, and it does not apply to probationary employees, who are assessed on suitability rather than just cause.

Has this employee completed their probationary period?
Is the conduct established on the evidence, and is it culpable rather than a matter of capacity or innocent absence?

To what extent is this true?
Why? — one or two sentences, while it is fresh

Assessment record

Indicated level

This is not a decision. It carries no authority of its own and is not evidence of anything. It is a structured record that the relevant factors were considered before the decision was made. The judgment remains yours, and it is a complement to legal advice rather than a substitute for it.

Factor by factor
